Abstract

The French Civil Code is one of the historical sources of Ecuadorian civil law. Traditionally, both legislations required cause as a validity requirement for legal acts, until the reform introduced by French Ordinance No. 2016-131 suppressed it as an autonomous element and codified its typical functions. Given the resulting normative divergence, the objective of this research was to contrast both regulatory schemes against specific facets of legal certainty: clarity, discretion, stability, and predictability, in order to determine the impact of each. Through a qualitative approach and the legal-doctrinal method, a historical, hermeneutic, comparative, and deductive analysis was structured, based on documentary and jurisprudential examination. The results showed that the French regulatory framework preserves cause based on casuistic regulation, whereas the Ecuadorian framework maintains it with an abstract formulation. Furthermore, against the adopted criteria, the former demonstrated better performance in stark contrast to the latter. It is concluded that the French legislative model has a positive impact on legal certainty, while the Ecuadorian model generates tensions with this principle; therefore, a reform is proposed.
