Registration mechanisms for proving co-ownership of movable property acquired during common-law marriages in Ecuador: implications for legal certainty

This research analyzed the inadequacy of registration mechanisms for proving co-ownership of movable property acquired during common-law marriages in Ecuador, as well as its implications for legal certainty and notarial practice. The objective was to evaluate this regulatory gap and propose an alternative aimed at strengthening asset disclosure. The methodology was developed using a qualitative approach, with a dogmatic-propositive and bibliographic-documentary design, employing analytical and dogmatic methods, as well as documentary analysis techniques and interviews with professionals in the notarial field. The results showed that the lack of disclosure mechanisms for movable property generates an information asymmetry that facilitates the unilateral disposal of property by the apparent owner, affecting the rights of the former co-owner and weakening legal certainty. Furthermore, it was identified that restoring the previous marital status after the termination of a de facto union contributes to obscuring the existence of joint property ownership. It is concluded that the problem lies not in a lack of legal recognition, but rather in the absence of effective mechanisms for disclosing assets. In this regard, the inclusion of the former partner's name on the national identity card is proposed as a measure to strengthen transparency and prevent legal disputes.
