The nullity of Resolutions Issued by the Office of the Comptroller General of the State Due to Lack of Jurisdiction in Ecuador

The administrative oversight exercised by the Comptroller General's Office (CGE) in Ecuador faces crucial challenges related to competition, compliance with deadlines, and the expiration of resolutions. The CGE plays a fundamental role in ensuring transparency and the proper use of public resources; however, the failure to issue resolutions in a timely manner negatively affects the effectiveness of its functions and generates uncertainty for both audited entities and the public. The main problem in this situation lies in the violation of the rights of those being audited, as excessive procedural timelines can invalidate the sanctions imposed and delegitimize oversight. The research question focuses on how the expiration of resolutions and the lack of competition in oversight processes impact the efficiency of the CGE, undermining public trust in state institutions and hindering the development of public policies. This study is justified by the need to optimize the CGE's internal processes to ensure that resolutions are issued within the established legal deadlines, thereby improving the efficiency of administrative oversight and strengthening trust in the system. The objective is to analyze the scope of the powers of the State Comptroller General's Office, to determine and report responsibilities as a result of the oversight actions it carries out.
