Culpable homicide due to medical malpractice in Ecuador

Culpable homicide due to medical malpractice in Ecuador is an issue closely related to the right to life and, consequently, to the recognition of human rights. Reflecting on it is a necessary exercise that motivates the objective of this article, to analyze the treatment of this legal type in the Ecuadorian legal framework. For this, a descriptive investigation was carried out, based on exegetical methods, content analysis, analytical-synthetic and historical-logical. Among the main findings is that: the crime of manslaughter due to medical malpractice in Ecuador does not have regulations according to the needs that are involved in this type of crime and it is these gaps that seriously affect fair decision making. for those involved. It is urgent to improve the regulatory-legal framework to overcome the gaps in the criminal law on medical malpractice.
